Empowering the Sunbury Community

SUNBURY VOTERS HAVE A DECISION TO MAKE.

On November 3, 2026, Sunbury voters will decide whether to amend the City Charter to prohibit the construction of large-scale data centers above the amendment's 25-megawatt threshold.

Learn what the amendment says. Understand the history. Explore the research. Read the source documents.

The Measure in 60 Seconds

What is it?

A citizen-initiated amendment to the Sunbury City Charter concerning the construction of large-scale data centers.

What would it change?

If approved, the amendment would add Article XI, Section 11.05, "Prohibition of Construction of a Data Center," to the Sunbury City Charter, and it would prohibit the development of hyperscale data centers within city limits.

What facilities would it affect?

The proposed language establishes a threshold based on aggregate power demand. Reporting on the certified amendment identifies that threshold as more than 25 megawatts.

Who decides?

Sunbury voters.

When?

Tuesday, November 3, 2026.

Why is it on the ballot?

Residents used the citizen-petition process to propose a Charter amendment. The Delaware County Board of Elections certified 351 valid signatures, and Sunbury City Council subsequently certified the proposed amendment for placement on the November ballot.

The Current Situation

In November 2024, Sunbury announced an economic-development incentive for Amazon Data Services for a proposed $2 billion data center campus in the city's new limited-industrial business park.

The proposal subsequently generated extensive public discussion about land use, utilities, noise, water, traffic, economic development, taxation, and the appropriate role of residents in determining Sunbury's future.

In April 2026, City Council unanimously adopted a temporary moratorium on the establishment of data centers through January 31, 2027, while the city evaluates its regulation.

The Charter Amendment presents voters with a separate question: whether a restriction on large-scale data centers should be placed directly into Sunbury's governing Charter.
